Perch Minimum Advertised Price (MAP) Program
Perch Minimum Advertised Price (MAP) Program is designed to help authorized resellers maintain the long term strength of Perch brand equity by insuring they are able to engage in advertising that best conveys to end users the value of Perch Products.
We believe that this program, described below, will allow resellers to profitably market and effectively promote the value of Perch to end users.
Minimum Advertised Price (MAP):
The Minimum Advertised Price for Perch products are listed as the MAP Prices for those products as outlined in Table 1.
A complete list of applicable products and MAP prices can be found in Table 1.
This MAP Program will apply to all Advertisements (defined below) of MAP Product(s) by resellers, including, without limitation, in-store, out of home, print, and online.
- “Advertisements” is defined as any and all advertisements in all media including, but not limited to, inserts, newspapers, magazines, catalogs, public signage, billboards, any other print media, television, radio, e-mail, internet websites or other ecommerce, flyers, posters, coupons, brochures, any use of hypertext transfer protocol or internal links to a web based shopping cart and any other electronic media.
- All advertisements of MAP Product(s) must include the Perch model name and a price at or above the MAP.
- MAP products may only be advertised as standalone products and may not include any promotional allowances (eg rebates, coupons, free premiums, reward program offerings, etc.), except for Honey-Can-Do International, LLC authorized promotions (eg manufacturer’s rebates).
- This MAP Policy does not apply to any reduced price that a reseller wishes to place within a purchaser’s online shopping cart as a final stage of an online purchase(s), so long as the end user enters the final stage on his/her own without any reference on the website that a lower price will be found at the final purchasing stage.
MAP Violation Penalties:
Any advertisement(s) that does not comply with terms of this MAP Program will be deemed a violation by the MAP review board. Each incidence of advertised product below MAP subsequent to the 1st violation, regardless of model, will be treated as an additional violation. Honey-Can-Do International, LLC will directly communicate MAP violations to reseller accounts on a monthly basis.
Honey-Can-Do International, LLC will issue a warning letter to resellers for any violation(s) that has occurred. The reseller will have 72 hours to increase the price(s) to coincide with MAP. After 72 hours, Honey-Can-Do may cease shipping on any of the violated SKU’s until the item(s) are brought up to MAP.
Honey-Can-Do International, LLC will issue a warning letter to resellers for any violation(s) that has occurred. Item(s) that are found in violation of Perch MAP will be zeroed out in said violators inventory, will have their inventory immediately suspended, and a “Stop Ship” will be placed on pending orders until the pricing coincides with Perch MAP Policy. Continued violations could result in termination of the reseller relations on MAP items with Perch.
Honey-Can-Do International, LLC will issue a warning letter to resellers for any violation(s) that has occurred. Inventory will be immediately suspended for 14 days from receipt of this notification. In addition, a “Stop Ship” will be placed on any pending orders. Continued violations could result in termination of the reseller relations on MAP items with Honey-Can-Do.
Monitoring and Reporting:
Honey-Can-Do International, LLC will monitor advertised prices of MAP Products, either directly or via the use of third parties. Third parties retained by Honey-Can-Do International, LLC may monitor reseller’s advertisements and website advertising including, but not limited to, review of advertised prices.
Changes to Policy:
Honey-Can-Do International, LLC may change or cancel this program at any time.
